These Terms of Service ("Terms") govern your use of the TLAP mobile application ("App") and related services operated by Flatland Foundry LLC ("we," "us," or "our"), a Maryland limited liability company. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old and hold a valid commercial driver's license (CDL) or be involved in commercial trucking operations to use the App. By using the App, you represent that you meet these requirements.
To use the App, you must create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.
TLAP is a truck route planning and navigation application that provides load-aware, truck-legal routing with Hours of Service (HOS) scheduling, fuel stop optimization, load securement check planning, and turn-by-turn navigation. The App is designed as a planning tool for commercial truck drivers and fleet operations.
Free Trial: New users receive a limited number of free route optimizations ("Trial Routes"). Once your Trial Routes are exhausted, a paid subscription is required to continue using route optimization features.
Pro Driver Subscription: The Pro Driver subscription provides unlimited access to route optimization and all App features. Subscription pricing, billing frequency, and terms are displayed in the App and on Google Play at the time of purchase.
Billing: All subscription payments are processed through Google Play. By subscribing, you agree to Google Play's terms of service regarding billing, renewals, and refunds. We do not directly collect or store your payment information.
Cancellation: You may cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
Founding Member Pricing: Users who participate in alpha or beta testing may be offered special pricing or benefits at our discretion. The specific terms of any founding member offer will be communicated at the time it is made.

TLAP IS A ROUTE PLANNING TOOL, NOT A REPLACEMENT FOR PROFESSIONAL JUDGMENT.
Hours of Service: The HOS clocks and scheduling features in the App are for route planning purposes only. They are NOT an official Record of Duty Status (RODS) and do NOT replace your Electronic Logging Device (ELD) or paper logs as required by 49 CFR Part 395. You are solely responsible for maintaining accurate, legally compliant HOS records.
Routing: While the App uses commercial vehicle routing profiles and regulatory data to plan truck-legal routes, route conditions change frequently. Road restrictions, bridge clearances, weight limits, construction zones, and local ordinances may not be reflected in real time. You are responsible for verifying that any route is safe and legal for your specific vehicle and load before and during travel.
Load Compliance: The App's load classification, constraint engine, and securement check scheduling are planning aids. They do not guarantee regulatory compliance. You are responsible for ensuring your vehicle, load, permits, placards, and securement meet all applicable federal and state requirements.
Navigation: Do not operate the App while driving in a manner that distracts you from safe operation of your vehicle. Pull over to a safe location before interacting with the App's interface. Voice-guided navigation is provided as a convenience and does not relieve you of the responsibility to observe road signs, signals, and conditions.
The App, including its design, code, algorithms, data compilations, trademarks, and content, is the property of Flatland Foundry LLC and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
The App relies on third-party services for routing (TomTom, HERE Technologies), map display (Mapbox), authentication (Google), and payment processing (Google Play). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or performance of third-party services.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Trip plans and vehicle profiles are stored locally on your device. Account and subscription data are stored on our servers. We do not sell your data.
You may delete your account at any time from within the App or by visiting tlap.app/delete-account. Account deletion permanently removes all your data from our servers. Locally stored data on your device is removed when you uninstall the App. If you have an active subscription, you must cancel it separately through Google Play — deleting your TLAP account does not automatically cancel your Google Play subscription.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLATLAND FOUNDRY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE APP'S ROUTING, NAVIGATION, HOS CALCULATIONS, CONSTRAINT ANALYSIS, OR ANY OTHER FEATURE WILL BE ACCURATE, COMPLETE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR USE. COMMERCIAL MOTOR VEHICLE OPERATION IS INHERENTLY DANGEROUS, AND YOU ASSUME ALL RISK ASSOCIATED WITH RELYING ON THE APP'S OUTPUT FOR ROUTE PLANNING OR NAVIGATION DECISIONS.
You agree to indemnify, defend, and hold harmless Flatland Foundry LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Flatland Foundry LLC regarding your use of the App and supersede any prior agreements.
